RESOLUTION: DEFENDING THE RIGHT TO STRIKE AND GENERAL STRIKE PREPAREDNESS

Motion presented at GMM — September 26, 2026

WHEREAS Bill C-39, the Building Canada Strong Act, was introduced by the federal government on September 21, 2026, proposing significant amendments to the Canada Labour Code, including expanded provisions for government intervention in labour disputes;

WHEREAS the proposed amendments would establish circumstances under which the federal Labour Minister could direct the Canada Industrial Relations Board to order the resumption of operations, extend an existing collective agreement on an interim basis, or impose a binding dispute-resolution process;

WHEREAS the right of workers to withhold their labour is fundamental to meaningful collective bargaining and to securing fair wages, benefits, working conditions and job security;

WHEREAS collective bargaining depends upon workers and their unions retaining meaningful bargaining power at the negotiating table;

WHEREAS the Canadian Labour Congress and other labour organizations have raised serious concerns that Bill C-39 would expand the federal government’s power to intervene in legal strikes and weaken workers’ bargaining power;

WHEREAS the Canadian Labour Congress has characterized the proposed powers as giving the federal government exceptionally broad authority to intervene in legal strikes;

WHEREAS CUPW members have a direct interest in defending the right to strike and maintaining workers’ ability to exercise collective power through lawful collective action;

WHEREAS defending the right to strike requires solidarity and coordinated action across unions, locals, sectors and communities;

BE IT RESOLVED THAT

CUPW Local 846 direct CUPW National to engage immediately with the Canadian Labour Congress, affiliated unions and the broader labour movement to build a coordinated strategy for collective action, including a general strike, in defence of the right to strike and free collective bargaining;

BE IT FURTHER RESOLVED THAT CUPW National work with the broader labour movement to establish the coordination, timelines, democratic processes and practical preparations necessary to carry out effective collective action, including a general strike;

BE IT FURTHER RESOLVED THAT CUPW National provide members with clear information regarding Bill C-39, its proposed changes to the Canada Labour Code, and their implications for collective bargaining and the right to strike;

BE IT FURTHER RESOLVED THAT CUPW National make the defence of the right to strike a priority and pursue the broadest possible solidarity and coordination across the Canadian labour movement;

BE IT FINALLY RESOLVED THAT CUPW Local 846 submit this resolution to CUPW National for consideration at the appropriate national body and call upon CUPW National to bring this issue forward to the Canadian labour movement.
