CEASE AND DESIST ARBITRATION: UPDATE

November 24, 2021

CUPW’s arbitration hearing against Canada Post’s vaccination practice was held today. We presented evidence and expert witness testimony, and the Union believes it provided ample evidence for Arbitrator Burkett to suspend Canada Post’s vaccination practice.

While we continue to encourage voluntary vaccination for members, frequent
rapid testing is an alternative, for people who do not want to be vaccinated, that will help to keep workplaces safe and ensures members are treated fairly and their rights are protected.

Special Leave versus Personal days

November 22nd,2021

There have been many questions about when members can use paid special leave; hopefully the following will help explain some of this.

Clause 21.03 Leave for Other Reasons {page 174 of the Urban Collective Agreement} says:

“Where conditions warrant it, special leave with pay may be granted when circumstances not directly attributable to the employee, including but not limited to illness in the immediate family, as decided in clause 21.02, prevent his or her reporting for duty.
Such leave will not be unreasonably withheld. An employee can only be granted leave with pay under this clause once he or she has exhausted all of his or her Personal Days.”

CANADA POST’S MANDATORY VACCINATION PRACTICE: CUPW UPDATE

November 18, 2021

CUPW has filed a cease and desist application against Canada Post’s vaccination practice which will be heard by Arbitrator Burkett on November 24, 2021. We have also filed national grievances against the practice.

CUPW supports voluntary COVID-19 vaccination, and is proud that many of our members have been vaccinated. However, CUPW is concerned that the mandatory vaccination practice goes farther than required.

If you’re actively at work, you’ll attest by calling the toll-free number 1-833-433-1442 by November 12, 2021. If you’re not actively at work, you’ll be expected to attest before returning to work.
